This criminal appeal has been filed against the judgement and order dated 03.04.2003, passed by the Additional Session Judge, Court No.2, Azamgarh in S.T. No.67/1993 (State vs. Suresh Singh) under Sections 452, 504, 354, 323, 506 I.P.C. and Section 3(1)(10) and 3(1)(11) S.C./S.T. Act, Police Station Kotwali, District Azamgarh, convicting the appellant (accused) under Section 452 I.P.C. sentencing him to undergo rigorous imprisonment for 2 years and imposing a fine of Rs.500/- and in default of payment of fine, additional six months simple imprisonment, under Section 504 I.P.C. sentencing him to undergo rigorous imprisonment for six months, under Section 354 IPC sentencing him to undergo rigorous imprisonment for 2 years and imposing a fine of Rs.500/- and in default of payment of fine, additional six months simple imprisonment, under Section 506 IPC sentencing him to undergo rigorous imprisonment for 2 years, under Section 3(1)(10) S.C./S.T. Act, sentencing him to undergo rigorous imprisonment for six months and imposing a fine of Rs.500/- and in default of payment of fine, additional six months simple imprisonment, under Section 3(1)(11) S.C./S.T. Act, sentencing him to undergo rigorous imprisonment for six months and imposing a fine of Rs. 500/- and in default of payment of fine, additional six months simple imprisonment have been imposed upon him.
From perusal of the report of Chief Judicial Magistrate, Azamgarh dated 24.06.2021, it transpires that the sole appellant- Suresh Singh, has died.
In view of the above stated fact that the sole accused appellant has since expired during the course of the pendency of this appeal, this criminal appeal stands abated.
Consequently, this criminal appeal is dismissed as abated on account the death of the accused-appellant.
The present criminal appeal is accordingly, dismissed.
