Prayer in this petition is for grant of anticipatory bail to the

petitioner in FIR No.31 dated 28.04.2016 under Sections 406/498A IPC

registered at PoliceStation Sadar Moga, Tehsil and District Moga.

It is informed that the matter has been amicably resolved between

the parties before the Mediation and Conciliation Centre of this Court on

05.04.2017. Petition under Section 13B of the Hindu Marriage Act, 1955 has

been filed. Statements of the parties at first motion have been recorded. A sum

of ` 6,00,000/- out of the total settled amount of `12,00,000/-, has been received

by the complainant which she has further deposited in the Post Office in fixed

deposit for nine years as per the terms and conditions of the settlement.

Mr. Singla, learned counsel for the complainant submits that

visitation rights of the petitioner, qua the child shall be respected. Both the

complainant as well as the petitioner undertake to adhere to the terms and

conditions of the settlement. Learned counsel for the complainant submits that

the complainant has no objection if this petition is allowed subject to strict

adherence to the terms and conditions of the settlement arrived at between the

parties.

Keeping in view the facts and circumstances as above, especially

the settlement arrived at between the parties, but without commenting upon or

expressing any opinion on the merits of the case, this petition is allowed.

Petitioner shall join investigation if/as and when required. In the

event of his arrest, petitioner shall be released on bail to the satisfaction of

Investigating Officer. Petitioner shall comply with the conditions stipulated in

Section 438(2) Cr.P.C.
