Criminal Procedure in connection with Itahar P.S. Case No.128 of 2019
dated 10.05.2019 under Sections 498A/302 of the Indian Penal Code
and Sections 3/4 of the Dowry Prohibition Act.

The petitioner undertakes to affirm and stamp the petition as per

the Rules within 48 hours of resumption of normal functioning of the

court. The petition is taken up through video conference on the basis of

such undertaking.

The petitioner accepts that the petitioner hit his wife with a

pressure cooker on the heat of the moment without having any

intention to seriously injure her or kill her.

The petitioner says that the petitioner has been in jail for a

considerable period and there may not be any need for the further

custodial interrogation of the petitioner since the investigation has been

completed.

Considering the time that the petitioner has already spent in

custody and the fact that it is unlikely that any new material may be

discovered against the petitioner now that the petitioner has admitted

his role in the incident, the petitioner may be released on bail.

The petitioner shall be released on bail upon furnishing security

of Rs.10,000/- (Rupees Ten Thousand only) and personal release bond

of equivalent amount to the satisfaction of the appropriate court in

Uttar Dinajpur. The petitioner will also be required to attend every date

fixed for the trial and any unexplained absence will entitle the criminal

court to cancel the bail without reference to this court.

CRM 2935 of 2020 and CRAN 1369 of 2020 stand disposed of.
