Re:- An application for anticipatory bail under
Section 438 of the Code of Criminal Procedure filed on

And

In Re:

Anit Ghosh alias Rana

…. Petitioner

Ms. Devipriya Mitra,
Mrs. Juin Dutta Chakraborty
.. for the Petitioner
Mrs. Anasuya Sinha

.. for the State

The petitioner seeks anticipatory bail in connection

with Nimta Police Station Case No.360 of 2018 dated

21.09.2018 under Sections

498A/323/325/328/354/354A/368/ 406/156/120B of

the Indian Penal Code.

The charge against the petitioner is that this

petitioner in connivance with the second husband of the

complainant have got the daughter from the

complainant’s first marriage admitted to a fake

rehabilitation centre and are attempting to drive her to

lunacy to grab her properties.

On prima facie satisfaction that the centre for

rehabilitation run by this petitioner may not be qualified

or may be a bogus centre only for the purpose of

generating income, a previous petition of this petitioner

for anticipatory bail has been rejected earlier today.

The State produces the case diary and refers to the

medical report which reveals substantial injuries suffered

by the victim. The victim’s statement under Section 164

of the Code is also on record.

Considering the material against the petitioner, his

prayer for anticipatory bail is rejected and CRM 9373 of

2018 is dismissed.
