It is submitted on behalf of the petitioner that she is no way
related to the husband of the victim.
Learned lawyer for the State opposes the prayer for
anticipatory bail and submits that the petitioner has an illicit affair
with the husband of the de facto complainant.
Having considered the materials on record and keeping in
mind the extent of complicity of the petitioner in the alleged assault
on the victim, we are inclined to grant anticipatory bail to the
petitioner.
Accordingly, we direct that in the event of arrest, the petitioner
be released on bail upon furnishing a bond of Rs.10,000/- (Rupees
Ten Thousand Only), with two sureties of like amount each, to the
satisfaction of the arresting officer and also be subject to the
conditions as laid down under Section 438(2) of the Code of Criminal

Procedure, 1973. Petitioner shall appear before the investigating
officer and hand over her passport, if any, within a period of four
weeks from date. In the event the petitioner does not have a
passport, she shall personally appear before the investigating officer
and furnish an affidavit to that effect within the time frame
mentioned herein above.
The application for anticipatory bail is, thus, disposed of.
