It is submitted on behalf of the petitioner that he is in custody for 102 days
and that investigation is complete.
Learned counsel appearing for the State opposes the prayer for bail.
We have considered the materials in the case diary and bearing
in mind the nature of allegations against the petitioner and the period of
detention suffered by him and that the investigation is complete, we are
inclined to grant bail to the petitioner.
Accordingly, the petitioner shall be released on bail upon
furnishing a bond of Rs. 10,000/‐ with two sureties of like amount, one
of whom must be local, to the satisfaction of the learned Chief Judicial
Magistrate, Berhampore, Murshidabad subject to the condition that he
shall appear before the trial court on every date of hearing and shall not
intimidate witnesses or tamper with evidence in any manner
whatsoever.
In the event he fails to appear before the trial court without justifiable cause,
the trial court shall be at liberty to cancel his bail in accordance with law without
further reference to this court.
The application for bail is, thus, allowed.
