In Re : An application for bail under Section 439 of the Code of
Criminal Procedure in connection with Duttapukur P.S. Case
No.954 of 2017 dated 17.11.2017 under Sections 498A/304B/
34 of the Indian Penal Code
And
In the matter of : Titul Mazumder @ Titul Majumdar
…Petitioner.
Mr. Biplab Roy,
Ms. Rashmi Roy …for the Petitioner.
Mr. Pradipta Ganguly …for the State.
It is submitted on behalf of the petitioner that he is in
custody for 201 days and it is further submitted that co-accused
persons, namely, Sadhan Majumder and Jhumpa Majumder
being the in-laws of the victim housewife have been granted bail
by this court.
Learned counsel appearing for the State opposes the
prayer for bail.
Having considered the materials on record and bearing
in mind the fact that co-accused persons, namely, Sadhan
Majumder and Jhumpa Majumder who are similarly
circumstanced with the petitioner have been granted bail by
this court, we are inclined to extend the same relief to the
petitioner also.
2
Accordingly, we direct that the petitioner shall be
released on bail upon furnishing a bond of Rs.10,000/-(Rupees
Ten Thousand only) with two sureties of like amount, one of
whom shall be local, to the satisfaction of the learned Chief
Judicial Magistrate, North 24 Parganas at Barasat on condition
that he shall appear before the trial court on every date of
hearing and shall not intimidate witnesses nor tamper with
evidence in any manner whatsoever.
In the event the petitioner fails to appear before the trial
court, the trial court shall be at liberty to cancel his bail without
further reference to this Court.
