Heard on I.A. No. 12631/2017, an application for grant of
interim maintenance pendente lite and expenses of proceedings under
Section 24 of Hindu Marriage Act.
As per the reply filed by the appellant, respondent filed
proceeding under Section 125 of Cr.P.C. for grant of maintenance
along with her daughter.
Trial Court granted maintenance of Rs. 3,000/- per month in
favour of the respondent and Rs. 4,000/- per month in favour of
daughter, total Rs. 7,000/- per month. In our opinion a sufficient
amount for maintenance has been granted by the Court under Section
125 of Cr.P.C. in favour of the respondent and her daughter, hence, it
is not necessary to pass any order under Section 24 of Hindu Marriage
Act for grant of maintenance as granted by the Court under Section
125 of Cr.P.C. subject to modification if any made by the Higher
In regard to grant of legal expenses, it is directed that the
appellant shall pay expenses of Rs. 10,000/- as legal expenses towards
litigation filed before this Court within a period of three months from
C.C. as per rules.
