In Re: Viku @ Abdulbari Sk. ….. petitioner

Mrs. Karabi Roy
…..for the petitioner

Mr. S. G. Mukherjee, learned P.P.,
Mr. Aniket Mitra
….for the State

It is submitted by the learned Counsel appearing for the

petitioner that he is the elder brother-in-law of the victim housewife

and has been falsely implicated in the instant case. The victim is a

married sister and her husband had developed illicit affair with

another person.

Learned Counsel appearing for the State opposes the prayer for

anticipatory bail.

Having considered the materials on record and bearing in mind

the nature of allegations and in view of extent of complicity of the

petitioner in the alleged crime, we are inclined to grant anticipatory

bail to him.

Accordingly, we direct that in the event of arrest the petitioner

shall be released on bail upon furnishing a bond of Rs.10,000/-, with

two sureties of like amount each, to the satisfaction of the arresting
2

officer and also be subject to the conditions as laid down under

Section 438(2) of the Code of Criminal Procedure, 1973 and on

conditions that he shall appear before the court below and pray for

regular bail within a period of four weeks from date.

This application for anticipatory bail is, thus, allowed.
