Session Trial No.119 of 2016 arising out of Jagatballavpur Police Station Case No.154/2015 dated 24.6.2015
under Sections 498A/326/307/34 of the Indian Penal Code.

Heard the learned Advocates appearing on behalf of the parties.

Perused the case diary.

The petitioner is in custody for 630 days. Charge sheet has

already been submitted. Charge has also been framed and the trial has

already been commenced.

Upon consideration of the materials in the case diary, more

particularly the dying declaration of the victim housewife as also taking

into consideration the fact that trial has already been commenced, we do

not think that this is a fit case to grant bail to the petitioner.

Accordingly, such prayer is rejected and the application for bail

stands dismissed.

However, the learned court below is directed to expedite the trial.
