1. Heard learned counsel for the Applicant and the Learned APP

for the State.

2. The Applicant is 57 years’ old lady, the mother-in-law of the

Complainant. She is apprehending her arrest in the FIR bearing C.R.

No. I-03 of 2020 registered at Kinhavali Police Station, Dist. Thane

for the offences punishable under Sections 498A, 328, 323 of the

Indian Penal Code,1860.

3. It is the case of prosecution that on 30 th April, 2017, when the

complainant was present in her matrimonial house, the Applicant

and her son forcibly made her drink phenyl, w hereafter, she fell

unconscious and, therefore, was removed to Primary Health Centre

at Dolkhamb.

4. I have perused the certificate issued by the doctor attached to

Primary Health Centre, wherein he has certified her blood pressure

was 110/70 when brought to the hospital and was unconscious.

Another certificate shows that no injuries were noticed on person of

the Complainant.

5. When questioned, whether the statements of the neighbour or

person who had removed her to the hospital has been recorded or

not, the learned APP seeks time to verify. Time granted. The co-

accused (father-in-law) has been granted pre-arrest bail by this

Court in ABA No. 310 of 2020 which has been listed for further

consideration on 9th March,2020.

6. Tag his application with ABA No. 310 of 2020. Stand over to

9th March, 2020.

7. Hence, the following order:

ORDER

(a) In the meantime, in the event of arrest of the applicant in

Crime No. 3 of 2020 registered with Kinhavali Police Station, the

Applicant shall be released on furnishing PR bond for the sum of

Rs.20,000/- with one or more sureties in the like amount.

(b) The Applicant shall report to the Investigating Officer on 26 th

February, 2020 and 4th March, 2020 between 11.00 a.m. to 1.00 p.m.

(c) Stand over to 9th March, 2020.
