Heard Sri Ram Jatan Yadav, learned counsel for the applicant, Sri Gaurav Pratap Singh, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
The first bail application of the applicant was rejected by this Court vide order dated 22.12.2017. This is the second bail application moved on behalf of the applicant.
The new ground which has been argued by learned counsel for the applicant is that the applicant is the husband of the deceased and is languishing in jail since 22.6.2017. He further submits that in spite of the trial being expedited by this Court vide order dated 22.12.2017, the trial has not yet been concluded though the copy of the said order expediting the trial was produced before the trial Court on 27.3.2018 and only two witnesses of fact have been examined. The applicant is in jail since 22.6.2017.
Learned A.G.A. has opposed the prayer for bail and submitted that the trial is progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant-Ved Prakash @ Dev Prakash involved in Case Crime No.391 of 2017, under Sections 498A, Section304B I.P.C. and Section 3/4 D.P. Act,Police Station Bairiya, District Ballia.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same preferably within a further period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
