This Criminal Petition is filed under Section 439 of
Cr.P.C praying to enlarge the petitioner on bail in
Cr.No.199/2018 registered by K.R.Puram Police Station,
Bengaluru and now in C.C.No.55838/2018 pending on the
file of X Addl. C.M.M., Bengaluru for the offence p/u/s
498(A) and 304(B) of IPC.

This Criminal Petition coming on for Orders, this day,
the Court made the following:

ORDER

K.R. Puram Police have chargesheeted the petitioner

in Cr.No.199/2018 of their police station for the offences

punishable under Sections 498A and 304B of IPC.

2. Marriage of the petitioner with victim-Dasari Divya

was solemnized on 24.11.2016. She committed suicide in

the house of the petitioner on 03.04.2018 by hanging

herself. It is alleged that petitioner subjected her to

physical and mental cruelty in connection with his demand

for cash of `25,00,000/- which drove her to commit

suicide.

3. Though physical cruelty is attributed to the

petitioner, the inquest mahazar states that except the

ligature mark, there were no other external injuries. Post

Mortem report shows two simple contusions.

4. Though it is alleged that the cruelty was in

connection with demand for dowry, the police have not

chargesheeted for the offences punishable under the Dowry

Prohibition Act.

5. Petitioner is in judicial custody since 06.04.2018.

Under these circumstances, it may not be just and proper

to subject him to pre-trial conviction and sentence.

6. Therefore, the petition is allowed. Petitioner is

granted bail in Crime No.199/2018 of K.R.Puram Police

Station, which is pending in C.C.No.55838/2018 on the file

of the 10th Addl. Chief Metropolitan Magistrate Court,

Mayohall, Bengaluru subject to the following conditions:

1) The petitioner shall execute personal bond
in a sum of `50,000/- and furnish two
sureties in the like-sum to the satisfaction
of the Magistrate for his appearance;

2) He shall appear before the Court as and
when required for the purpose of
enquiry/trial;

3) He shall not tamper the prosecution
witnesses by threats, inducement or
otherwise;
