ORAL ORDER

5 06-07-2018 Heard learned counsels for the petitioner and the State.

The petitioner, already in custody, seeks bail in

connection with Sadar P.S.Case No. 80 of 2018 registered

under Sections 147, 148, 149, 302, 307, 323, 324, 341 and 120B

of the Indian penal Code.

Allegation in brief is that FIR named accused persons

assaulted indiscriminately with iron rod and lathi to informant’s

brother along with one Shoyeb. informant’s brother died at the

spot and Shoyeb succumbed to injury later on.

Submission is that earlier petitioner was granted

provisional bail on 22.06.2018 to perform marriage of his

daughter with direction to surrender on 2nd July, 2018 and

accordingly he has surrendered and filed surrender certificate.

Learned counsel submits that petitioner is not named in the FIR

and there is no eye witness inclusive of the informant and

another co-accused Sadhu Yadav, also not named in the FIR,

was earlier released on bail by co-ordinate Bench of this Court

vide Cr. Misc. No. 36399 of 2018 and petitioner has only one

antecedent in a case registered under Sections 354 I.P.C.

Having considered the aforesaid facts and circumstances,

the petitioner, namely, Vijay Kumar Ray, is directed to be

released on bail upon furnishing bail bond of Rs. 10,000/- with

two sureties of the like amount each to the satisfaction of the

learned CJM, Darbhanga in connection with Sadar P.S. Case

No. 80 of 2018.
