This revision petition is directed against order dated
08.10.2018, passed by Addl. District Judge, Mansa, vide which, in a
divorce petition filed by petitioner Simarjeet Kaur against her husband
Vijay Kumar, on an application under Section 24 of the Hindu Marriage
Act, 1955, having been moved by her, she has been granted maintenance
pendente lite @ Rs.3000/- per month with Rs. 5000/- as litigation
expenses.
The respondent-husband is aggrieved by the said order,
submitting that the maintenance granted is on the higher side, more
particularly, when the petitioner-wife is highly qualified and is working
as a teacher in a private school, besides giving tuition at home. However,
the trial Court has considered all these aspects observing that the
respondent/husband had failed to substantiate those allegations by

bringing on record any documentary evidence, considering the fact that
respondent/husband is an able-bodied person who can easily earn
Rs.300/- per day i.e. Rs.9000/- per month; 1/3rd of that amount has been
granted to the petitioner/wife as maintenance pendente lite.
The order is well reasoned, based upon proper appraisal of
evidence and correct appreciation of law. There is no illegality or
infirmity therein, which might have called for interference by this Court
while exercising revisional jurisdiction. There being no merit in the
revision petition, the same stands dismissed.
