1 Learned senior counsel for the applicants seeks leave to

amend to implead the complainant as party respondent No. 2. Leave

granted. Amendment be carried out forthwith. Mr. Nitin Kaskar,

learned counsel waives notice on behalf of added respondent No. 2-

complainant.

2 Heard learned senior counsel for the applicants.

3 By this application, the applicants seek pre-arrest bail in

connection with C.R. No. I-646 of 2019 registered with the Waliv Police

Station, Vasai, District Palghar, for the alleged offences punishable under

Sections 304B, 406, 498A, 323, 504, 506 r/w 34 of the Indian Penal Code.

4 Learned senior counsel for the applicants submits that the

applicant No. 1 is the father-in-law, applicant No. 2 is the mother-in-law

and applicant No. 3 is the sister-in-law of the deceased. He submits that the

deceased-Jyoti was married to Vimal on 29 th November 2017. He further

submits that Jyoti’s husband-Vimal used to work at Faizabad, Uttar Pradesh

and that the deceased was also working as Class-I Officer at Patna. He

further submits that on 3rd August 2018, the complainant (mother of Jyoti)

took her home, as she was pregnant and on 13 th March 2019, a baby-boy

was born. He submits that on 29th May 2019, Jyoti came to Mumbai to stay

with her sister and committed suicide on 10th June 2019.

5 Learned senior counsel submits that as far as the applicants are

concerned, the allegations are of a general nature and that Jyoti was not

residing with the applicants for about ten months prior to the suicide. He

submits that even in the suicide note, there are no specific allegations as

against the in-laws and sister-in-law. Learned senior counsel submits that

the applicants would hand over the streedhan of the deceased-Jyoti to the

Investigating Officer and are also ready to hand over all her belongings to

the complainant/Investigating Officer.

6 Learned A.P.P as well as learned counsel for the respondent

No.2-complainant, to take detailed instructions.

7 In the meantime, till the next date, the applicants are granted

interim protection on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicants be enlarged on bail on

executing P.R. Bond in the sum of Rs.25,000/- each, with one or two

sureties in the like amount;

(ii) The applicant Nos. 2 and 3 shall report to the Investigating

Officer of the concerned Police Station on 1st, 2nd, 7th and 8th August

2019 from 10:00 a.m. to 12:00 noon;

(iii) The applicant No. 1 shall also report to the Investigating

Officer of the concerned Police Station, on his return from Patna;

(iv) The applicants to hand over the streedhan and the belongings

of the deceased to the complainant/Investigating Officer of the

concerned police station, before the next date.

8 Stand over to 20th August 2019. To be listed on the

supplementary board.

9 All concerned to act on the authenticated copy of this order.
