ORDER

The petitioners herein have been arrayed as accused Nos.2 3

among the three accused in the instant Crime No.1557/2019 of

Neyyattinkara Police Station, Thiruvananthapuram, wherein the

offence alleged now are those punishable under Secs.306, 498A 34 of

the Indian Penal Code. The crime was initially registered on 05.11.2019

under Sec.174 of the Cr.P.C on account of the unnatural death/suicide

committed by the lady victim involved in this case. The lady victim

involved in this case is the wife of the 1 st accused. The two petitioners

(A-2 A-3) are the father and mother of A-1. It appears that the case

of the prosecution is that after the marriage of the abovesaid spouses,

the accused persons have treated the lady with cruelty and harassment,

etc. and that 1st accused has assaulted the lady and has caused injury to

her by placing a hot iron box on her hands and that he has not

permitted her to attend to coaching classes for appearing in the Public

Service Commission Examinations, inspite of her repeated requests,

etc. It appears that A-1 has been arrested, remanded and later let out

on regular bail. Further it appears that serious allegations are placed

mainly as against A-1, who is the husband of the deceased lady.

2. Having regard to the facts and circumstances of this case,

this Court is inclined to take the view that the custodial interrogation of

the petitioners herein may not be necessary or warranted, for

effectuating the smooth and fair conduct of the investigation in this

crime. Accordingly, it is ordered that in the event of the petitioners

being arrested in relation to the instant crime, they shall be released on

bail on their separately executing bond for Rs.40,000/- (Rupees Forty

Thousand only) and on their separately furnishing two solvent sureties

for the like sum each, both to the satisfaction of the Investigating

Officer concerned. However, the above order shall be subject to the

following conditions:

(i) The petitioners shall not involve in any criminal offences of
similar nature.

(ii) The petitioners shall fully co-operate with the investigation.

(iii) The petitioners shall report before the Investigating Officer
as and when required in that connection.

(iv) The petitioners shall not influence witness or shall not
tamper or attempt to tamper evidence in any manner,
whatsoever.

3. If the petitioners violate any of the above conditions, the

jurisdictional Court concerned will stand hereby empowered to

consider the application for cancellation of bail, if required, and pass

appropriate orders in accordance with law.

With these observations and directions, the above Bail

Application will stand disposed of.
