02/ 20.09.2018 Heard learned counsel for the petitioners as well as

learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection

with Ravilganj P. S. case no. 187/2018.

Admittedly, except section 354 of the IPC all

sections are bailable. So far as section 354 IPC is concerned,

submission on behalf of the petitioners is that there is case

and counter case between the parties and, as a matter of fact,

an altercation took place between the parties on the alleged

date of occurrence and the informant inserted the story of

outraging her modesty with an object to make offence


Considering the aforesaid facts and circumstances

as well as submissions of the parties, it is ordered that in the

event of arrest/ surrender within four weeks from the date of

receipt of this order to the concerned court, let the

petitioners be released on bail on furnishing bail bonds of

Rs 10,000/- each with two sureties of the like amount each

to the satisfaction of the Addl. Chief Judicial Magistrate

VIII, Saran at Chapra in Ravilganj P. S. case no. 187/2018

subject to condition as laid down under section 438(2) of the


shahid (Hemant Kumar Srivastava,J)
