Heard on the question of admission.
This petition has been filed under Article 227 of Constitution of India
questioning the validity of order dated 23.01.2020 (Annexure P/1) passed by
the Family Court, Khandwa whereby the Court while deciding the application

filed by the wife under Section 24 of Hindu Marriage Act awarded
maintenance pendente lite @ of Rs.3000/- per month and Rs.5,000/- towards
cost of the litigation. As per the direction given by the trial Court Rs.5,000/-
has to be paid in two installments, first installment of Rs.2,500/- would be
paid before starting the evidence of applicant and Rs.2,500/- in terms of
second installment would be paid before starting the evidence of non-
applicant.
Learned counsel for the petitioner submits that so far the award of
maintenance pendent lite is concerned, he has no objection but he is objecting

the amount of Rs.5,000/- awarded towards litigation expenses.
However, on perusal of order passed by the Court, I do not find any
infirmity in the order.
It is made clear that the amount of Rs.5,000/- which has to be paid
once that too in two installments. However, the petitioner would pay the
amount of Rs.3,000/- per month towards maintenance pendent lite to the
respondents.

The petitioner is, therefore, without any substance is hereby dismissed.
