appellant.
Ms. Anjana Singh Tomar, learned counsel for
the respondent.
I.A. No. 3172/2018 is taken up for
consideration whereby respondent seeks grant of
maintenance pendente lite and for legal expenses.
Taking into consideration that the respondent
is not shown to have any independent source of
income and is dependent on her mother for her
livelihood and that the appellant is person of
means; irrespective of the fact that an application
under Section 125 Code of Criminal Procedure,
1973 which was dismissed by order dated
14/08/2015 on the ground that she was getting
interim maintenance in pending suit, we are of the
considered opinion that the respondent is entitled
for maintenance pendente lite and the legal expenses,
which we quantify to Rs. 5,000/- per month and
Rs.3,000/- respectively. The amount of maintenance
shall be deposited by the appellant in the account
of respondent on or before 10th day of each

Gregorian (English) Calendar month, from the date
of filing of application i.e. 09/07/2018. The
respondent shall give her account number to the
