imprisonmentfor3yearseachandtopayfineofRs.25,000/-each,in

default,tosufferrigorousimprisonmentforonemontheach,fortheoffence

punishableunderSection498Ar/w34SectionoftheIndianPenalCodeandfor

theoffencepunishableunderSection306r/w34oftheIndianPenalhave

beensentencedtobesufferrigorousimprisonmentfortenyearseachand

topayfineofRs.25,000/-each,indefault,tosufferrigorousimprisonment

forthreemonthseach.

6.Theapplicant’sappealhasbeenadmittedbythisCourtvide

orderdated14thMarch,2018.Itappearsthatdeceased-Varshawas

marriedtotheapplicantin2003andthecouplewasresidingatDombivali.

On25thJuly,2003,deceased-Varshahungherselfinthematrimonial

houseandexpiredon26thJuly,2003.Accordingtotheprosecution,the

applicantwasinsistingthatdeceased-Varsha’sfather’sflatbetransferred

inhisname.Theapplicantisalsoallegedtohavedemandedmoney.The

prosecutioncaserestsentirelyoncircumstantialevidence.Itisnotin

disputethattheapplicantwasonbail,pendingtrialandthathehasnot

VyankatnarayanChaudharii.e.applicant’sbrotherhasbeenenlargedonbail

bythisCourt(Coram:A.M.Badar,J.)videorderdated8thJune,2018.The

applicantisincustodysince25thJanuary,2018.

7.Consideringtheaforesaid,theapplicationisallowedandthe

applicant’ssentenceissuspendedandheisenlargedonbail,pendingthe

hearingandfinaldisposalofhisAppeal,onthefollowingtermsand

conditions:

i)TheApplicantbeenlargedonbailonfurnishingP.R.Bondin

thesumofRs.25,000/-withoneortwolocalsolventsuretiesinthelike
