IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
BENCH AT JAIPUR
S.B. CRIMINAL MISC. BAIL APPLICATION NO.
5012/2017
Virendra @ Bunti Son of Ratan Lal by Caste Bawariya,, R/o
Azad Nagar, Police Station Chiksana, District Bharatpur (raj.)
(At Present in Central Jail, Bharatpur)

—-Petitioner
Versus
State of Rajasthan through P.P.
—-Respondent

For Petitioner : Mr. G.S. Shekhawat
For Respondent : Mr. V.S. Godara, P.P.

HON’BLE MRS. JUSTICE SABINA
Order
18/4/2017

Petitioner has filed this petition under Section 439

Code of Criminal Procedure, 1973 seeking regular bail in F.I.R.

No.57/2017 registered at Police Station Chiksana, District

Bharatpur for offences under Section 354 Indian Penal Code,

1860 and Section 7 8 of Protection of Children from Sexual

Offences Act, 2012.

Learned counsel for the petitioner has submitted

that as per the prosecution, petitioner had outraged the

modesty of the petitioner aged about ten years. In-fact, the

present case is a counter-blast to the FIR got registered by

the father of the petitioner against the complainant Vipin

relating to murder of Rohitash (brother of the petitioner).

Since, the petitioner side had failed to effect a compromise

with the complainant party in the murder case, present FIR
(2 of 2 )

has been got registered against the petitioner. Petitioner is in

custody since 31.1.2017. Challan has already been presented

in the court and conclusion of trial may take time.

Learned State Counsel on the other hand, has

opposed the petition.

Keeping in view the facts and circumstances of the

case, it would be just and expedient to order the release of

the petitioner on bail.

Accordingly, without expressing any opinion on the

merits of the case, this petition is allowed. Petitioner be

admitted to bail subject to satisfaction of the Trial Court.
