Heard Sri Rajesh Kumar Mishra, learned counsel for the applicant, Sri Vivek Sharma and Sri P.C. Srivastava, learned counsel appearing for the informant and learned A.G.A. for the State.

It is submitted by learned counsel for the applicant that the present matter relates to a matrimonial dispute between the husband and wife and the said matter can be well considered by Mediation Centre of this Court.

It is directed that applicant shall deposit a sum of Rs. 20,000/- within two weeks from today with the Mediation Centre out of which Rs. 16,000/- shall be paid to the wife of the applicant for appearance before the Mediation Centre. The remaining amount shall go to mediation centre towards the expenses of mediation.

The matter is remitted to the Mediation Centre with the direction that same may be decided after giving notices to both the parties.

It is directed that Mediation Centre shall decide the matter expeditiously preferably within a period of three months.

Accordingly, in the meanwhile, let the applicant-Vishva Deep Singh, involved in Case Crime No. 353 of 2019, under section 498A, 323, 307, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Amroha Dehat, District Amroha (J.P. Nagar), be released on interim anticipatory bail on his furnishing a personal bond of Rs.25,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the concerned police station subject to the following conditions:-

(i) the applicant will join and participate in each and every aspect of “Investigation” and will lend full assistance to the Investigating Agency even with regard to “discovery of fact” if and when required so by the Investigating Agency or theconcerned Court;

(ii) the applicant shall make himself available for interrogation by a police officer as and when required;

iii) the applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police office;

(iv) the applicant shall not leave India without the previous permission of the Court and if he has a passport, the same shall be deposited by him before the S.S.P./S.P. concerned.

In case of default or breach of any of the aforementioned conditions it shall be open to the Investigating Officer to file an appropriate application before this Court for cancellation of the interim anticipatory bail granted.
