1. The petitioners have preferred this criminal misc.
petition under Section 482 Cr.P.C. seeking quashing of FIR
No.38/2017 registered at Police Station Mahila, District Sri
Ganganagar for the offence under Sections 498A 406 of IPC.
2. At the outset, learned counsel for the petitioners
submits that the matter has been fully compromised between the
parties. Learned counsel for the petitioners has shown certified
copies of the orders in other cases pertaining to same matrimonial
dispute, in which compromise has been reflected. Learned counsel
for the petitioners submits that the petitioners shall produce all
the documents relating to compromise before the I.O.
3. In light of the such submission, the present petition is
disposed of with a direction to the I.O. to take the compromise on
record and complete the investigation strictly in accordance with
law. The petitioners shall not be arrested in connection with FIR
No.38/2017 registered at Police Station Mahila, District Sri
Ganganagar.
4. However, if during the investigation, the concerned
investigating authority needs to arrest the petitioners, then the
petitioners shall be given 15 days notice before making such
arrest. The petitioners shall be at liberty to approach this Court
again, in case need arises. However, it is made clear that the
petitioners shall be required to join and completely co-operate
with the investigation.
