1. The applicant is apprehending arrest in connection with CR
No.I-515 of 2019 registered with Kalwa Police Station, Thane, for
offences under Section 498A r/w 34 of Indian Penal Code. The
marriage between applicant and complainant was performed on 6 th
June 2015. The FIR was lodged on 4th November 2019.

2. Learned advocate for applicant submitted that the complainant
had left the matrimonial home on 19 th April 2019 and thereafter the
FIR was lodged in November-2019. It is further submitted that the
victim had visited the matrimonial home and had taken away
ornaments belonging to her.

3. Learned APP submitted that Stridhan of the complainant is
required to be recovered from the applicant. The FIR was registered
u/s 498-A r/w 34 of IPC. However, subsequently Section 406 has
been added.

4. The applicant was granted interim protection by Sessions
Court during pendency of application. The application was rejected
on 13th March 2020. In the circumstances, applicant can be directed
to co-operate with investigation with interim protection. Hence, I
pass following order :

ORDER

(i) In the event of arrest of applicant in connection with CR No.I-
515 of 2019 registered with Kalwa Police Station, Thane, the
applicant be released on bail on executing PR bond in the sum of
Rs.25,000/- with one or more sureties in the like amount;

(ii) The applicant shall report the Investigating Officer on 23 rd and
24th March 2020 between 11 am and 1 pm;

(iii) In the event investigating agency conducts search at the
residence of applicant, the applicant and his family members shall
allow the same and co-operate with the investigation;

(iv) This interim protection is granted till 3 rd April 2020. Stand
over to 3rd April 2020. To be listed on supplementary board.
