Learned counsel Dr. Acharya submits that the police did not
find the offences proved against the petitioners who are Jeth and
Jethani of the respondent complainant and a final report was
submitted qua them in the court concerned. As per Dr. Acharya,
the learned trial court was absolutely unjustified in framing charge
against the petitioners for the offences under Sections 498A and
323 of the IPC.

The matter requires consideration.
Issue notice of the misc. petition as well as stay application
to the respondents. Learned Public Prosecutor accepts notice on
behalf of respondent State. Thus, notice be issued to respondent
NO.2 only returnable on 01.05.2020.

Till next date, further proceedings of the Criminal Case
No.197/2018 pending in the Court of Judicial Magistrate,
Hanumangarh shall remain stayed qua the petitioners.

List on 01.05.2020.
