The hearing has been conducted through video conferencing.
1. Learned counsel for the petitioners has brought to the notice of this
court that in Canada as per the statement of the account between the parties
not only the issue of the child’s custody but all the properties interse the
complainant and her husband was settled, the same also included the
jewellery, which was entrusted at the time of marriage. Learned counsel for
the petitioners state that in view of the settlement having been arrived at
Canada and both the parties have separated now the continuation of the
proceedings in the FIR in question are an abuse of the process of court
2. Learned counsel for the respondent no.2 vehemently states that
irrespective of the allegations under Section 406 IPC, there are specific
allegations against the petitioners of having meted the complainant with

cruelty. Learned counsel for the respondent no.2 seeks some time to point
