applicant no. 1 – State.
The First Information Report is registered on
12.07.2019 for the offences punishable under Sections
302, Section498A and Section34 of the Indian Penal Code. The
investigation is at preliminary stage and because of this
we expressed our disinclination to entertain the matter at
this stage.
In view of the above, learned Advocate for the
applicants sought permission to withdraw the application
with liberty to approach this Court again under Section
482 of the Code of Criminal Procedure, after sometime.

As we have not examined the merits of the
challenges in the application, following order is passed:
i) Criminal application is disposed as
withdrawn with liberty to the applicants to
approach this Court again after sometime.
ii) The non-applicant no. 1 is directed that after
completion of investigation and before filing of the
charge-sheet, if charge-sheet is to be filed against
the present applicants, the Investigating Officer
shall give one months notice to the applicants to
enable them to approach this Court.
