1 Heard learned counsel for the applicant.
2 By this application, the applicant seeks pre-arrest bail in
connection with C.R. No. 146 of 2019 registered with the Agripada Police
Station, Mumbai, for the alleged offences punishable under Sections 498A,
Section377, Section34 of the Indian Penal Code.
3 Learned counsel for the applicant submits that the applicant is
the husband of the complainant. He submits that the applicant was married
to the complainant according to Muslim rites on 27 th September 2018. He

submits that the complainant has alleged that after 15-20 days, the
applicant and his sister demanded a motorcycle worth Rs. 8,50,000/- and
assaulted her with a leather belt. The applicant is alleged to have
demanded Rs. 1,00,000/- for repair work, which was brought by her,
however, the same was spent by the applicant on gambling and
intoxication. He submits that the complainant has also alleged that certain
wooden articles were brought from her father worth Rs.3,00,000/- for
renovating the applicant’s house. He submits that the aforesaid FIR is an
outcome of a matrimonial dispute and that there is no truth in the
allegation.
4 Learned A.P.P seeks time to take instructions.
5 In the meantime, till the next date, the applicant is granted
interim protection on the following terms and conditions :
ORDER
(i) In the event of the arrest, the applicant be enlarged on bail on
executing P.R. Bond in the sum of Rs.. 20,000/- with one or two
sureties in the like amount ;

(ii) The applicant shall report to the Investigating Officer of the
concerned Police Station on 15th, 16th and 17th July 2019 from 10:00
a.m. to 1:00 p.m., and thereafter, as and when called.
6 Stand over to 30th July 2019.
7 All concerned to act on the authenticated copy of this order.
