The Dangerous Machines (Regulation) Act, 1983

 

 

17. LIABILITY OF THE MANUFACTURER FOR REIMBURSEMENT. –

 

Whenever any person operating a dangerous machine suffers death or dismemberment of any limb or any other bodily injury –

 

(i) by reason of any manufacturing defect in the machine whereby such death, dismemberment or injury was caused, or

 

(ii) by reason of the omission of the manufacturer to comply with the provisions of this Act and the rules and orders made thereunder. such manufacturer shall be liable to reimburse the person by whom compensation had to be paid under this Act to the members of the family of the person whose death was caused by such machine or, as the case may be, to the person by whom such dismemberment or bodily injury was suffered.
