The Delhi Land (Restrictions on Transfer) Act,1972

 

 

3. Prohibition on transfer of lands acquired by Central Government –

 

No person shall purport to transfer by sale, mortgage, gift, lease or otherwise any land or part thereof situated in the Union territory of Delhi which has been acquired by the Central Government under the Land Acquisition Act, 1984 or under any other law providing for acquisition of land for a public purpose.

 

COMMENTS:

 

This Section is a restrictive provision whereby the privilege of transfer of land is curtailed, of the common man, when such land has been acquired by the Central Government under the provision of Land Acquisition Act, 1894 or any other Law which provides for acquisition of land for a public purpose. OPC Jain v. ADM (LA) and other 42 (1990) DLT 478
