49. WELFARE OFFICERS. –
(1) In every factory wherein five hundred or more workers are ordinarily employed the occupier shall employ in the factory such number of Welfare officers as may be prescribed.
(2) The State Government may prescribe the duties, qualifications and Conditions of service of officers employed under sub-section (1).
An Assistant Personnel Officer of a factory cannot be held that he was in fact appointed as a Labour Welfare Officer simply because as a Assistant and Personnel officer he was looking after the problems of the labourers and the welfare of the labourers and when the number of labourers in the concerned factory was less than 100 and there was no statutory requirement to appoint a Labour Welfare Officer; Shyam Vinyals Ltd. v.
