The Trade and Merchandise Marks Act,1958

Section 89. Cognizance of certain offences

(1) No Court shall take cognizance of an offence under Sec. 8 1, Sec. 82 or Sec. 83 except on complaint in writing made by the Registrar or any officer authorised by him in writing.

(2) No Court inferior to that of a Sessions Judge, Presidency Magistrate or Magistrate of the first class shall try an offence under this Act.
