Agreements void for uncertainty\u00a0&#8211;<\/h2>\n<p>\u00a0<\/p>\n<p>Agreements, the meaning of which is not certain, or capable of being made certain, are void.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Illustrations<\/strong><\/p>\n<p>\u00a0<\/p>\n<p>(a) A agrees to sell B \u201ca hundred tons of oil\u201d. There is nothing whatever to show what kind of oil was intended. The agreement is void for uncertainty.<\/p>\n<p>(b) A agrees to sell B one hundred tons of oil of a specified description, known as an article of commerce. There is no uncertainty here to make the agreement void.<\/p>\n<p>\u00a0<\/p>\n<p>(c) A, who is a dealer in coconut-oil only, agrees to sell to B \u201cone hundred tons of oil\u201d. The nature of A\u2019s trade affords an indication of the meaning of the words, and A has entered into a contract for the sale of one hundred tons of coconut-oil.<\/p>\n<p>\u00a0<\/p>\n<p>(d) A agrees to sell B \u201call the grain in my granary at Ramnagar\u201d. There is no uncertainty here to make the agreement void.<\/p>\n<p>\u00a0<\/p>\n<p>(e) A agrees to sell to B \u201cone thousand maunds of rice at a price to be fixed by C\u201d. As the price is capable of being made certain, there is no uncertainty here to make the agreement void.<\/p>\n<p>\u00a0<\/p>\n<p>(f) A agrees to sell to B \u201cmy white horse for rupees five hundred or rupees one thousand\u201d. There is nothing to show which of the two prices was to be given.
