The petition at hand, concededly, was directed against the order dated 03.11.2015 of the Court of Sessions, whereby the second respondent was admitted to anticipatory bail in case FIR No. 15/2015 of Police Station Sunlight Colony involving offences under Section 313/34 IPC.

The counsel for the petitioner fairly conceded that, as submitted by the counsel for the second respondent, that the charge-sheet has since been filed in the Court of competent jurisdiction and cognizance has already been taken thereupon and on the application in that context moved, the second respondent has been enlarged on regular bail. In these facts and circumstances, the anticipatory bail order dated 03.11.2015 stands exhausted it having served its purpose. The petition seeking cancellation of the said order, therefore, cannot survive and is dismissed.
