DELHI DCP CIRCULAR – Summoning/examining the official(s)

It has come to notice that instructions contained in circular No.55/C&T/92 issued vide No.45628-80/C&T/AC-IV/PHQ dated 19.11.92 regarding summoning/examining the official(s) of Government Department are not being followed meticulously.

In a recent case a senior officer in the Ministry of Communication and Information Technology, New Delhi was summoned/called directly without informing his head of office. The contents of the above mentioned circular are reiterated below:-

“It has been decided that henceforth in cases where an official in a Govt. department is to be examined in his official capacity, a letter should go from the DCP/Unit to the incharge of the office concerned requesting him to ensure the examination of the official itself instead of being called to the Police Station, a letter could go to the concerned Head of the Institution giving particulars of case registered and kind of assistance required.

In this connection reference is also invited to PHQ’s endst.No.45036-85/C&T/AC-IV/PHQ dated 16.11.92 vide which the following observations of L.G. has been conveyed to all for compliance:-
“It is salutary convention that the police may not enter an educational institution even for criminal investigation and apprehension of accused without informing the Head of the Institution. The same applies to Govt. office, Public Sector Undertakings etc. This convention should be observed.”

It is, therefore, emphasized upon all concerned that these instructions may be strictly complied with, failing which severe action shall be taken against the defaulting official(s).
