ORAL ORDER

3/ 29-08-2017 It has been submitted that the case has been

registered under Section 376-D of the Indian Penal Code but

charge-sheet has been submitted against the accused/petitioner

under Section 354 Indian Penal Code.

Learned APP has submitted that the victim in her

statement under Section 164 Cr. P. C. has supported her case

before the Magistrate.

Counsel for the petitioner is not able to answer as to

whether cognizance has been taken in this case or not.

In view of such, Additional Chief Judicial

Magistrate, 2nd, Jhanjharpur, Madhubani, is directed to send the

Xerox copy of the cognizance order of Rudrapur P.S. Case No.09

of 2017, if any, so as to reach this Court within two weeks next.

Put up immediately on receipt of the same.
