Heard on I.A.No.29069/2023, this is the first application for suspension
of sentence and grant of bail to the sole appellant-Devlal.

Vide judgment dated 01.12.2023 passed by learned Sessions Judge,
District Dindori in S.T.No.17/2017, the appellant has been convicted for
offence punishable under Sections 457 of IPC and sentenced to undergo R.I.
for one year with fine amount of Rs.100/- and Section 354 IPC and sentenced
to undergo RI for one year with fine of Rs.100/- and Section 3(1)(B)(i) of
SC/ST Act and sentenced to undergo R.I. for six months with fine amount of
Rs.100/- and Section 3(2)(va) of SC/ST Act and sentenced to undergo R.I. for
one year with fine amount of Rs.100/-, with default stipulations.

Learned counsel for the appellant submitted that during trial the appellant

was on bail. The trial Court has suspended the jail sentence of the appellant till
29.12.2023. This Court vide order dated 22.12.2023 has again extended the
suspension of sentence till next date of hearing. Hence, prayed for suspension
of sentence of the appellant be extended.

Considering the facts and circumstances of the case and also considering
the facts that during trial the appellant was on bail and the trial Court has already
suspended, this application is allowed.

I t is directed that subject to payment of fine amount, if not already

deposited, execution of jail sentence of appellant shall remain suspended during
pendency of this appeal and he be released on bail on his furnishing a personal
bond for the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one
solvent surety in the like amount to the satisfaction of the trial Court for his
appearance before the trial Court on 14.03.2024 and thereafter on all the
subsequent dates as may be fixed by the trial Court in this regard during the
pendency of this appeal.

List for admission after receipt of record.
