The petitioner has filed affidavit of service.

None appears for the added opposite party no. 2 despite

receipt of notice.

State of West Bengal is represented through counsel.

The petitioner, being the accused, has approached before this

Court for a direction upon the learned Magistrate for expeditious

disposal of the CGR 2133 of 2016, corresponding to T.R. 440 of

2017, arising out of Charumarket Police Station Case No. 86 dated

May 10, 2016 under Section 498A/Section406/Section34 of the Indian Penal

Code and Sections 3/Section4 of the Dowry Prohibition Act by filing an

application under Section 482 read with Section 483 of the Code of

Criminal procedure.

Learned counsel appearing for the petitioner submits that the

present case was initiated on the basis of an First Information

Report, dated May 10, 2016. After completion of investigation,

charge sheet was submitted on June 28, 2016. The charge against

the present petitioner and others were framed on August 27, 2018.

Out of the five chargesheeted witnesses, none has been examined

by the learned Magistrate so far. According to his contention,

several dates were being fixed, but none of the prosecution

witnesses turned out. The next date for recording evidence of the

prosecution witnesses has been fixed on December 21, 2019.

Having regard to the submission made by the learned

counsel appearing for the petitioner, the learned Magistrate is

requested to take utmost effort to conclude the proceeding of the

present case as expeditiously as possible, preferably within a

period of one year from the date of communication of this order to

the court below. At the same time, the prosecution and defence

are directed to assist the learned Magistrate so that the trial can

be concluded within the time as framed by this Court

With the above directions, the present revisional application,

being C.R.R. 3406 of 2019, is disposed of.

Urgent photostat certified copies of this order, if applied for,

be made available to the parties upon compliance of necessary

formalities.
