the Code of Criminal Procedure.

It is submitted on behalf of the petitioner that a criminal

proceeding was instituted against him under Section

498A/406/34 of the Indian Penal Code at the behest of the

opposite party no.2. Subsequently to harass and humiliate the

petitioner, impugned proceeding has been initiated making false

and frivolous allegations which do not disclose ingredients of the

alleged offences.

Let this matter appear under the heading ‘Contested

Application’ four weeks after Puja Vacation.

Copy of the application be served upon the opposite party

No.1 through the learned Public Prosecutor, High Court, Calcutta

and upon the opposite party No.2 by registered speed post with

acknowledgement due and affidavit of service be filed on the next

date of hearing.

There shall be stay of the further proceeding in G.R. Case

No.278 of 2017 arising out of Pratima Police Station Case No.37 of
2

2017 dated 10.03.2017 under Sections 341/494/323/506/34 of

the Indian Penal Code pending before the learned Additional Chief

Judicial Magistrate, Kakdwip, South 24-Paraganas for a period of

six weeks after Puja Vacation or until further order, whichever is

earlier so far as the petitioner is concerned.

Liberty is given to the parties to apply for extension and/or

modification and/or variation and/or vacation of this order upon

notice to the other side.

Urgent photostat certified copy of this order, if applied for,

shall be given to the parties, as expeditiously as possible on

compliance of all necessary formalities.
