[Miss Smriti Sarkar vs. State of West Bengal Ors.]
Mr. Sakya Sen
Mr. D. Das Gupta
… for the State
Mr. Indranil Nandi
Mr. Sayak Konar
… for respondent nos. 16 to 20
Pursuant to order dated 19.7.2017, affidavit is filed on behalf
of the respondent no. 15 wherein it is stated that the complaint
appearing at page 46 of the writ petition was not received by the
police station and a general diary was lodged on 5.5.2017 being GD
Entry no. 395 dated 5.5.2017 which is bereft of any allegation of
outraging of modesty.
Nobody appears for the petitioner.
Perusing the averments in the affidavit and the annexures
thereto I am of the opinion that no complaint had been placed
before the police station alleging outraging of modesty of the
petitioner under section 354 IPC on 5.5.2017. Investigation has
already commenced on the complaint of the petitioner.
Accordingly, I dispose of the writ petition directing the
investigating agency to conclude the investigation in accordance
with law at an early date.
