It is submitted on behalf of the petitioners that

investigation was not completed within the time stipulated

under section 167(5) Cr.P.C and continuation of the impugned

proceeding is an abuse of process of court.

Let this matter appear under the heading ‘Motion

Adjourned’ one week after vacation.

Ms. Sinha is directed to appear in the matter as state

respondents. Copy of the petition be served upon her in court

today. Ms. Sinha is directed to produce case diary on the next

date of hearing.

Let copy of the petition be served upon the opposite

party no. 2 through registered speed post with

acknowledgment due and affidavit of service be filed on the

next date of hearing.

There shall be stay of operation of the order dated

29.8.2016 passed by the learned Additional Sessions Judge,

Baruipur, South 24 Pgs. in Criminal Revision No. 85A/2015

affirming the orders dated 21.5.2015 and 4.7.2015 passed by

the learned Additional Chief Judicial Magistrate, Baruipur,

South 24 Parganas in connection with GR case no. 35 of 2015

under Sections 498A/325/452/365/120B/34 of the Indian

Penal Code for a period of two weeks after vacation or until

further orders, whichever is earlier.

Liberty is given to the parties to pray for extension

and/or vacation and/or modification of this order upon notice

to the other side.
