In re:- Munshi Salam @ Salem Munshi Anr. …. Petitioners.
Mr. Suvadip Bhattacharjee … For the petitioners.
Mr. Saswata Gopal Mukherjee, P.P.,
Ms. Debjani Sahu …. For the State.
Heard the learned Advocates appearing on behalf of the
parties. Perused the case diary.
The petitioners are the father-in-law and brother-in-law of the
victim housewife. They are in custody for 63 days. Investigation is in
progress.
However, we take note of the fact that the mother-in-law and
the sister-in-law of the victim housewife, who were on similar footing,
have been granted bail by another Division Bench of this Court on
September 13, 2017 in CRM No.8964 of 2017.
Upon perusal of the materials in the case diary, we find that
our attention has not been drawn by the learned State Advocate
towards any materials showing necessity of further custodial detention
of the petitioners or that in the event, the petitioners are enlarged on
bail, they are likely to abscond.
In view of the above, we are inclined to allow the prayer of the
petitioners for granting bail.
2
Let the petitioners, namely, Munshi Salam @ Salem Munshi
and Mujibar Munshi be released on bail upon furnishing bond of
Rs.10,000/- each with two sureties of Rs.5,000/- each for each of the
petitioners, one of whom must be local, to the satisfaction of the
learned Additional Chief Judicial Magistrate, Arambagh, Hooghly.
The application for bail is, thus, disposed of.
