In re: An application for bail under Section 439 of the Code of Criminal Procedure filed on
August 23, 2017 in connection with Lalgola Police Station Case No. 108 of 2017 dated
March 18, 2017 under Sections 498A/304B of the Indian Penal Code, 1860.
And
In the matter of: Rakibur Sk. @ Rakibul Haque
…petitioner.
Mr. Robiul Islam,
Mr. Asif Iqbal
…for the petitioner.
Mr. Saswata Gopal Mukherjee,
Ms. Amita Gour
…for the State.
Heard the learned advocates appearing on behalf of the respective parties.
The accused/petitioner is seeking bail in connection with a case relating to offences
punishable under Sections 498A/304B of the Indian Penal Code, 1860.
Learned counsel for the petitioner submits that the petitioner is in custody for more
than 200 days and the investigation has been complete and charge-sheet has been
submitted and other co-accused persons have already been granted bail. Learned counsel
for the petitioner further submits that this petitioner has permanent residence and there is no
chance of absconsion and his custodial interrogation is also not required.
Learned counsel for the State while opposing the prayer for bail submits that the
petitioner is the husband and the principal accused and the prayer for bail was rejected in
the month of July and August, 2017 by this Court even after submission of charge-sheet.
Having considered the submissions made on behalf of the respective parties and the materials
available in the case diary and the nature and gravity of the offence, we are of the opinion that it is not a fit case
for granting bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.
The application for bail is, thus, disposed of.
