Prayer in this petition is for grant of anticipatory bail to the

petitioner in complaint No. Comp/IPC/5844/2012, dated 30.07.2012 under

Section 498A IPC.

None appears on behalf of the respondent despite service.

While issuing notice of motion, the contention noted on behalf

of the petitioner reads as under:-

” It is submitted that the petitioner had been regularly
appearing before the learned trial court in complaint
No.Comp/IPC/5844/2012 dated 30.07.2012 under Section
498A IPC. The petitioner’s application seeking exemption from
personal appearance was dismissed on 16.11.2016. It is due to
circumstances beyond his control that he could not appear
before the learned trial court. The petitioner undertakes to
appear on each and every date fixed before the learned trial
court.”

It is submitted that the petitioner has appeared before the

learned trial Court on 10.07.2017 in compliance with order dated

05.07.2017. Certified copy of order dated 10.07.2017 is taken on record

subject to just exceptions. The petitioner undertakes to appear before the

learned trial Court on each and every date fixed and further not abuse the

concession of bail. It is, thus, prayed that this petition be allowed.

Keeping in view the facts and circumstances noted above but

without expressing any opinion on the merits of case, it is considered just

and expedient to allow this petition. Consequently, interim bail granted by

the learned trial Court on 10.07.2017 is made absolute subject to the

petitioner submitting fresh bail bonds and surety to the satisfaction of the

learned trial Court.
