Heard learned Senior Counsel for the petitioner and

learned counsel representing the complainant – opposite party no. 2 as

also learned A.P.P. for the State.

Petitioner is the husband of the opposite party no. 2 and is

seeking quashing of the order dated 14.03.2014 passed by the learned

Chief Judicial Magistrate, Sitamarhi in Complaint Case No.

1824/2013 by which the learned Chief Judicial Magistrate has taken

cognizance of the offence under Section 498A IPC read with Section

4 of the Dowry Prohibition Act.

After some argument, learned Senior Counsel for the

petitioner seeks permission to withdraw this application seeking

liberty to raise all such pleas which are available to the petitioner at

the time of framing of charge.

The petitioner may do so if so advised.

The application is dismissed as withdrawn.
