2.TheF.I.R.islodgedon12/01/2019basedonthe

statementgivenbythedeceasedKarishmaBandiwadkar.The

statementwasrecordedasdyingdeclaration.Thedeceased

succumbedtoherinjurieson17/01/2019.Thedyingdeclaration

wasrecordedbyPSI,MandrupPolicestation.Shehasstatedthat

shegotmarriedninemonthspriortotheincident.Shewas

continuouslyharassedbypresentapplicants.Theapplicantsare

motherinlawandsisterinlawofthedeceased.Becauseoftheir

harassmentshehadcommittedsuicide.

3.TheallegationsintheF.I.R.arevague.Theallegations

donotpointoutthattheharassmentwasofsuchanaturewhich

wouldattractdefinitionofcrueltyU/s.498AofSectionI.P.C.orabettment

asdefinedinS.107ofSectionI.P.C.forthepurposeofattractingS.306of

SectionI.P.C.Moreover,dyingdeclarationisrecordedinthepresenceof

Karishma’sfather.Consideringalltheseaforementionedfacts,at

thisstage,itisdifficulttoobservethatpresentapplicantshad

abettedcommissionofsuicidebythedeceased.Therefore,inmy

view,theapplicantshavemadeoutacaseforgrantofanticipatory

bail.Thecustodialinterrogationoftheapplicantsisnotnecessary.

withoneortwosuretieseachinthelikeamount.
