Heard learned counsel for the accused petitioner, learned

Public Prosecutor and learned counsel appearing for the

complainant.

It is submitted by learned counsel for the accused petitioner

that after investigation, charge sheet has also been filed for

offences under Sections 306, 498A, 323 IPC and as per the

prosecution case, the deceased consumed poison herself,

therefore, at this stage, he is entitled to be released on bail.

Per contra, learned Public Prosecutor and learned counsel for

the complainant vehemently opposed the bail application.

After considering the entire facts and circumstances of the

case, without expressing any opinion on the merits of the case, I

consider it to be a fit case for grant of bail under Section 439

Cr.P.C. Accordingly, this criminal misc. bail application is allowed

and it is directed that the applicant Daangar S/o Nanu Giri

(arrested in connection with FIR No.93/2017, Police Station

Rajiyaser District Sriganganagar) shall be released on bail

provided he executes personal bond in the sum of Rs.50,000/-

with two sureties of Rs.25,000/- each to the satisfaction of the

learned trial court on usual conditions and shall appear before the

trial court on each and every date of hearing and whenever called

upon do to do so till the completion of the trial.
