PER COURT :
. This is the sheer abuse of process of law.

2. The original application filed under Section 482 of the Code of
Criminal Procedure, seeking quashment of the crime, was dismissed in
default by the order dated 03.02.2021. In order to seek its restoration,
Criminal Application No.1679/2021 was filed. By the order dated
09.12.2021 even that was dismissed in default. By way of this
application, another attempt has been made to seek restoration of the
original application.

3. Pertinently, as is being submitted by the learned Advocate for the
applicant, pursuant to the order dated 06.02.2018 passed in the main

application seeking quashment, interim relief was granted and the trial
has been stayed. It is pertinent to note that it is a regular criminal case
of the year 2017 for the offences punishable under Sections 498A,
323,
504, 506 read with 34 of the
Indian Penal Code. After having enjoyed
the benefit of the interlocutory order, the matter has been protracted.

4. The application is rejected with cost of Rs.5000/- to be deposited
within two weeks.
