This is third bail application under Section 439 of Cr.P.C. The

petitioner has been arrested in connection with C.R. Case

No. 243/2012, Police Station Phalodi for the offence under

Sections 498A, 304B and 302 of IPC

Learned counsel for the petitioner has filed the bail

application on the basis of the evidence of the doctor, wherein it is

stated that the death is suicidal and not homicidal. It is further

stated that the petitioner has almost undergone 5 years and 13

day.

In view of the above, this Court without taking into

consideration the merits of the case, deems it just and proper to

release the petitioner on bail in the above circumstances.

Accordingly, this third bail application under Section 439 of

Cr.P.C. is allowed and it is ordered that the accused-petitioner –

Shyam Singh S/o Kishore Singh shall be enlarged on bail provided

he furnishes a personal bond in the sum of Rs. 50,000/- with two

sureties of Rs. 25,000/- (out of which one of the surety shall be a local

surety) each to the satisfaction of the learned trial Judge for his

appearance before the court concerned on all the dates of hearing

as and when called upon to do so.

However, nothing said herein will have any bearing on the

merit of the case.
